Energy Conservation Act 2001 with Rules – Bare Act with Section Notes By Taxmann’s Editorial Board

Energy Conservation Act 2001 with Rules [Bare Act with Section Notes] by Taxmann is a one-volume statutory reference on India’s energy conservation law. It carries the Energy Conservation Act 2001 with eight sets of Rules, five sets of Bureau of Energy Efficiency (BEE) Regulations and the Carbon Credit Trading Scheme 2023.

You can find the text of the Act in official sources. What this book adds is the material needed to use it: Section Notes on key provisions, footnotes that trace amendments, the prescribed forms, and a detailed contents with a subject index to the Act.

This matters because the law is spread across many texts. Much of its working detail is in rules, regulations and schemes issued by the Central Government and the Bureau. This book brings together 14 of them, notified between 2007 and 2025. Seven of them have since been amended, and the footnotes trace the changes. The 2012 Rules alone carry amendments from six different years. A compliance team, auditor or adjudicating officer needs the current text of each instrument, the forms it prescribes, and a record of what changed and when. This book puts them in one place, with their forms and amendment notes.

This book is intended for the following audience:

• Designated Consumers – Energy Managers, Plant Heads and Compliance Teams in the industries and establishments listed in the Schedule to the Act, who file energy reports, act on audit findings and track energy savings certificates and carbon credit certificates
• Energy Professionals – Certified Energy Managers, Energy Auditors, Energy Auditors (Building) and Accredited Energy Auditor Firms, and candidates preparing for the BEE National Examination
• Appliance and Equipment Businesses – Manufacturers, Importers and Sellers who register products and display energy labels under the Standards and Labelling Programme
• Building Sector – Owners, Developers, Architects and Empanelled Energy Auditors (Building) working on code-compliant buildings
• Electricity Distribution Companies – Teams that prepare annual energy audit and periodic energy accounting reports
• Regulators and Adjudicators – Officials of the Bureau and State Designated Agencies, Inspecting Officers, and Adjudicating Officers of State Electricity Regulatory Commissions
• Legal and Sustainability Advisers – Advocates, company secretaries, ESG and carbon-market consultants, and students of energy and environmental law

The Present Publication is the 2026 Edition, covering the amended and updated text of the Energy Conservation Act [Act No. 52 of 2001] with Rules. The law stated in this book is updated till 15th August 2026.

The Act incorporates the amendments made by the Energy Conservation (Amendment) Act 2010 (effective 24^th August 2010), the Jammu and Kashmir Reorganisation Act 2019 (effective 31^st October 2019) and the Energy Conservation (Amendment) Act 2022 (effective 1^st January 2023). The Schedule to the Act includes the changes made by Notification S.O. 09(E) dated 3^rd January 2022. The noteworthy features of the book are as follows:

• [Section Notes on Key Provisions] Five provisions of the Act carry Section Notes. These are the definitions in section 2 (building, energy audit, Energy Management Centre and vessel), section 13A (use of a name resembling the Bureau’s), section 26 (penalties), section 48 (default by companies) and section 50 (protection of action taken in good faith). The notes run to 21 numbered paragraphs. Each one breaks the provision into its parts, such as conditions, amounts and exceptions, in short, layered bullet points
• [Amendment Trail in Footnotes] The Act carries 70 footnotes. Of these, 67 record the source and date of an insertion, substitution or omission. Across the book, 49 footnotes reproduce a provision as it read before it was substituted or omitted. These include the complete text of sections 32 to 43, which were omitted in 2010.
• [Commencement Notifications] Footnotes to sections 1 and 3 reproduce the three notifications that brought the Act into force in two phases (1^st March 2002 and 28^th June 2012) and set up the Bureau of Energy Efficiency (1^st March 2002)
• [Notification Details for Every Instrument] Each of the 14 Rules, Regulations and Scheme opens with its notification number and date. For the five BEE Regulations, the preamble also records the draft notification and the public consultation that came before them.
• [38 Forms] All 38 forms listed in the contents are printed. They range from energy reports and applications to certificates, notices, registers and an identity card format. The report structure and energy accounting formats for electricity distribution companies are printed as well
• [Label Artwork with Specifications] Schedule C of the 2026 Labelling Regulations is printed with its label artwork for 13 appliance heads. Each includes dimensioned drawings, colour-scheme drawings marked with colour codes and font sizes, and rules on label material and placement.
• [Fee and Examination Tables] Schedules A and B of the 2026 Labelling Regulations give the label fee for 18 mandatory and 25 voluntary appliance entries. The 2025 Certification Regulations carry five tables on examination fees, papers and marks, papers to be cleared, attempts and supplementary fees, and a subject-wise syllabus in Schedule I
• [Quick Navigation] A 13-page contents lists every section, rule, regulation, paragraph, form and schedule with its page number. A four-page Subject Index to the Act is keyed to section and clause numbers

The structure of the book is as follows:

• The Act — Each section opens with a bold side heading. Words inserted or substituted sit in square brackets, and omitted words show as [***]. Each change carries a footnote number, with the note at the foot of the page
• Section Notes — They follow the section text under a boxed “Comments” head. Numbered paragraphs (such as 26.2 and 26.2-1) carry short titles. The points under them run in up to three levels of bullets
• Rules, Regulations and Scheme — Each opens with its title, notification number and date, and the provisions it is made under. The rules, regulations or paragraphs follow with side headings. Forms and schedules come at the end
• Running Heads — They show the instrument’s short name and the section, rule, regulation, paragraph, form or schedule on the page
